Godfreys Online Store - Terms and Conditions of Sale
The Godfreys Online Store (Online Store) is operated by Australian Vacuum Cleaner Co Pty Ltd ABN 65 004 568 441 (Godfreys). These terms & conditions of sale (Sale Terms) govern the terms under which you contract with Godfreys when you lodge an online order form to purchase products and merchandise. It is a condition of purchase that before you submit an online order form (Order Form), you acknowledge that you have read, understood and agreed to these Sale Terms. These Sales Terms incorporate Godfreys' Privacy Policy (please see clause 12 below).
1. General
Godfreys may change these Sales Terms at any time. All products are advertised for sale in good faith and Godfreys will deliver all products ordered by you subject to these Sales Terms.
2. Availability of items
The sale of all products via the Online Store is subject to availability.
3. Submitting an Order Form
When making an order through the Online Store, you must abide by all of the instructions on the Order Form and provide all the required information. It is important that all details on the Order Form which are provided by you are correct. Godfreys will use the details on the Order Form to deliver the ordered products to you. Godfreys will also communicate with you using those details and will not be responsible for issues arising from errors in the details. All prices, taxes, the quantity of products and any other details included on the Order Form apply to your order. It is a condition of purchase that you acknowledge you have read and accept these Sales Terms. Once you have submitted your Order Form, Godfreys will send you an email confirming your order and receipt of payment.
4. Payment and GST
4.1 Payment and prices
All prices are in Australian dollars unless otherwise stated.
Payment of the correct price (and charges relating to delivery) must accompany all orders in the manner specified in the Online Store. No ordered products will be delivered by Godfreys without correct payment being received by Godfreys before delivery. Prices are subject to change without notice. However, you will only be obligated to pay the advertised price for the item at the time your order was placed. Online Store pricing may differ from prices available in on-site shops carrying Godfreys items. Products advertised as 'on sale' are only available at the reduced price during the applicable sale period and may be available in limited quantities and colours.
4.2 Taxes
Prices include GST (goods and services tax) unless stated otherwise.
5. Postage and handling
5.1 Delivery
- Godfreys offers delivery within Australia and New Zealand. Delivery within New Zealand is offered for orders lodged through Godfreys New Zealand website www.godfreys.co.nz.
- Delivery to destinations other than within Australia and New Zealand is subject to pre-agreement between you and Godfreys.
5.2 Delivery charges
You will pay all charges for the delivery of your ordered products, including postage, courier fees, transport, handling and insurance (where applicable). Details of those charges are available on the Online Store and will be specified as part of the price payable by you for your ordered products.
6. Delivery
6.1 Delays in delivery
Delays in delivery may occur as a result of factors such as supply problems or unexpected demand. Godfreys will endeavour to deliver the ordered products to you within 5 to 10 working days.
6.2 Delivery details
Please provide accurate delivery address details when placing an order. Godfreys does not deliver products to post office boxes and does not call customers prior to delivery to confirm the order details or delivery dates or times. Products purchased from Godfreys through the Online Store are delivered by either Australia Post or carrier under a separate delivery contract. As a result, ownership of the ordered products and the risk of their loss passes to you at the time Godfreys transfers the ordered products to Australia Post or the carrier for delivery to you.
7. Cancellation
Godfreys may cancel your order if a product is unavailable or if there is an error in the price or description of the product or in the details of the Order Form. If the order is cancelled, Godfreys will notify you via email and refund your payment (as per clause 9 below).
8. Returns, exchanges and refunds
In the absence of any breach of the manufacturer's express warranty or any implied statutory condition, goods purchased from Godfreys will only be exchanged for a product only store credit or a refund (excluding any freight costs), provided that:
(a) proof of purchase is submitted;
(b) the goods are returned to Godfreys within 10 days of purchase; and
(c) the goods have not been used and are in their original packaging.
If you wish to exchange a product because you ordered it in error or if you have changed your mind, you must pay the charges for packaging and delivery of the newly ordered product.

If you used a credit card to pay for your ordered product, refunds will be paid to the same credit card account. In other cases, refunds will be made by cheque made payable to you.
9. Manufacturer's Warranty
9.1 Duration of the warranty
All products sold through the Online Store carry the benefit of the manufacturer's warranty.
9.2 Warranty claim procedure
Any warranty claim (that the product does not comply with its warranty) can be organised through Godfrey's Melbourne dispatch depot at the following address:

Godfreys will arrange for the product to be inspected and, if necessary, repaired or replaced.
If the warranty claim is valid, Godfreys will cover all reasonable freight costs for sending the repaired or replaced product back to you. If the warranty claim is not valid, Godfreys will ask you to collect the product from wherever the product is located or to pay the costs of any repair and re-delivery to you.
Godfreys may repair or replace all or part of a product under a warranty claim, at Godfrey's option. If Godfreys determines that it is not possible or economical to repair or replace the product, Godfreys may refund the cost of the product.
9.3 Exclusions from warranty
The manufacturer's warranty does not cover and Godfreys is not liable for any loss or damage due to:
- Abuse or misuse of any product (including the machine, floor tools, hoses, rods, body, or any product accessories or use of any product for an unintended purpose), including:
- picking up liquids, plaster dust, powder or commercial or industrial use when the item is not designed for that purpose;
- dropping or causing any damage to the product; or
- Blockages of hose, filters, rods, and heads.
10. Personal information and the Godfreys Privacy Policy
Godfreys collects and uses the personal information you provide in using the Online Store and Website under the terms of Godfreys Privacy Policy.
The Privacy Policy can be accessed here or from the footer of the main page of the Website. The Privacy Policy forms part of these Sale Terms and you should therefore read the Privacy Policy before purchasing from the Online Store.
In this clause, 'personal information' means information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion (see the Privacy Act 1998 (Cth)).
11. Exclusion of liability
The functions of the Online Store may sometimes be interrupted by server outage and technological problems. While Godfreys will make reasonable efforts to ensure continuous online services, Godfreys does not take any responsibility for any inconvenience or consequences affecting your order, including the loss of your order.
In addition, Godfreys does not warrant that the Website or any other associated components, including emails sent, are free of viruses, spyware or other harmful elements. Godfreys will not be liable for any damages arising from the use of the Website, whether they be direct, indirect, punitive or consequential.
